Proposition 215

Although widely accepted as legalization, Proposition 215 only exempts the medical use of marijuana from criminal penalties. Proposition 215 and its progeny do not legalize marijuana. It changes how the police and the government treat “qualified patients” and their “primary caregivers”.

Proposition 215 exemptions do create new rights. As interpreted by the California Attorney General and case law, patients and caregivers have, among other rights, the right to join together to collectively cultivate and to transfer marijuana between each other.

The rights entrusted to qualified marijuana patients and caregivers are state rights. Under federal law, marijuana is still illegal.
